Terms and Conditions

  1. Pertinent definitions and clarifications:

    1. YankeeVictor400.shop, also referred to as "the store," "the website," "us," "we" refers to the online store that is accessed through the URL www.yankeevictor400.shop - whether it is directly inputed into a web browser, or linked to, etc. - and includes all of its subpages, sections and content.

      1. www.yankeevictor400.shop is operated by JAZ Creative LLC, a Limited Liability Company registered in Pearland, Texas, United States of America. 

    2. Customer (s) refers to individuals and/or entities that engage in business with the store. 

      1. For the purposes of this terms and conditions, engaging in business refers to a scenario in which the store collects payments in exchange for advertised products and/or services. 

    3. Site member (s), or member (s), refers to individuals or entities that have created a personalized profile on the website by "sining up," and completing the associated process, but have not engaged in business with the store.

    4. Guest (s) are customers who are not site members. 

    5. Visitor (s) refers to individuals and/or entities that access any section and/or content of the website without engaging in business with the store, and without creating a personalized profile. 

    6. User (s), also referred to as "you," "they" can be used to refer to any and all individuals or entities as defined in sections 1.2. through 1.5. as reasonably implied by context. 

    7. Product (s), refers to the tangible goods advertised for purchase from the store.

    8. Service (s) refers to intangible work provided by the store to customers, either as part of carrying out business (e.g. the act of shipping purchased products to customers), or as advertised for hire (e.g. certain craftsmanship work that at times may be provided). 

  2. Scope : The store and its users are bound by these terms and conditions, as updated, including all external sources cited, referenced, mentioned, and hyperlinked herein. 

  3. Disclaimer: The intent of the store is to engage in business in an ethical and non-malicious manner with its customers. However, the store is not exempt from making non-intentional errors and/or mistakes, a well as from Acts of God, that could prevent it from fulfilling its promise on an agreement as reasonably expected. However, this section does not exempt the store from all responsibility and/or liability.

    1. Examples of non-intentional errors that could prevent the store from fulfilling its promise on an agreement include, but are not limited to: Erroneous labeling of a product, advertising a product at the incorrect price, a delay in updating the inventory, a delay in shipping a product, shipping the erroneous product, shipping a product to the wrong address. 

  4. Responsibilities of the Store: 

    1. The store is responsible for providing reasonably accurate descriptions of products and services advertised for sale and/or hire, and to advertise the maximum price, with the exclusion of any applicable taxes, that a customer can expect to pay for a product and/or service. The shipping of products is a service provided by the store, the prices of shipping services can only be accurately advertised after a valid delivery address is known. 

    2. The store is responsible for fulfilling all transactions that result from engaging in business with customers, to the best of its ability. This means that the store shall deliver the products and/or services for which it has collected payment from customers in a reasonable time frame and in a satisfactory condition. 

    3. The store shall make customers aware as soon as practicable of a situation in which the store is not able to fulfill its promise on an agreement as reasonably expected, as provided by section 3. of these terms and conditions.

    4. The store is responsible for making amends when it cannot fulfill its promise on an agreement as reasonably expected, as provided by section 3. of these terms and conditions. These amends will be made in one of the following ways:

      1. Refund: When a product and/or service cannot be delivered and/or provided as reasonably expected, the store shall, as soon as practicable, refund to the customer the entire amount of money received in exchange of the expected products and/or services. The refund shall be made using the same method that the store used to collect payment, unless the customer and store agree to do so using a different method. 

      2. Replacement: As requested by customers, the store shall replace a product and/or service that the store agreed to deliver or fulfill, but that it finds itself unable to deliver or fulfill, with a different product and/or service of a monetary value equal to or 10% greater, but never less, than the monetary value of the product and/or service originally agreed to be delivered and/or provided. 

        1. A customer may choose to obtain a replacement product and/or service of a lesser monetary value than those included in the original order. In such case, the store shall refund the difference in cash, not to exceed 100% the monetary value of the original order, to the customer using the same methods specified in section 4.4.1. 

    5. The store is responsible for safeguarding, and not using in an unethical or malicious way, the information that it collects from its users as part of engaging in business and/or providing a personalized online shopping experience. 

      1. When needed in order to carryout business, the store will use third party companies and contractors such as online payment platforms and shipping/transportation/logistic companies. The store is responsible for using third party companies and contractors that are reputable and trustworthy, and that are unlikely to use the store's customers information in an unethical or malicious way.

    6. The store is responsible for updating this terms and conditions as required by applicable laws, and according to its own ethical principles. The store shall make reasonable attempts to notify its users of pertinent updates to these terms. 

  5. User Responsibilities 

    1. When an user decides to engage in business with the store, or to create a personalized profile, the store will require certain information from said users. Said users have the option to voluntarily, at their sole discretion, provide said information to the store if they wish to engage in business. Upon voluntarily agreeing to, users are responsible for providing to the store information that, to the best of their knowledge, is accurate, valid, and truthful. 

    2. Users shall not engage in fraudulent activities of any kind. These activities include, but are not limited to: impersonation, financial fraud, lying about the condition of a product and/or service received, any other activity or activities similar in nature to the aforementioned. 

    3. Users shall familiarize themselves with the store's return policy before engaging in business with the store. 

    4. Users are responsible for using the store's intellectual property in a way that is ethical and that does not violate the content's copyright. This means that the information included in this website shall not be taken out of context with the intent to deceive anyone. Additionally, the photos (including product photos), names and logos, as well as any other content that is exclusive to this website, such as this terms and conditions, shall not be replicated, and/or used for purposes other than those intended by the owner/creator without the express permission of YankeeVictor400.shop.

      1. Exceptions:

        1. Photos of products may be used by anyone as long as their use is in good faith and ultimately causes the store to reach, and potentially engage in business with, a greater number of users, and as long as the photos are not altered in any way (e.g. watermarks are not removed if present, etc.).

        2. Section 5.4. does not prevent users from sharing the website, or any of its sections and content, via hyperlinks, or by referral, with anyone without express permission. 

    5. Users are responsible for seeking clarification from a store representative, via the methods outlined in the "contact us section" of the website, regarding a policy, practice or procedure, when said policy, practice or procedure is not fully understood.

  6. Store Rights

    1. The store reserves the right, at its sole discretion, to refuse or cancel any order for any reason at any time. In all cases in which the store refuses and/or cancels an order, a refund for the entire amount received in the from of payment for said order will be issued using the same method that was used to collect that payment, if any was collected. 

    2. The store reserves the right to cancel and/or suspend any user account (personalized profile), at its sole discretion, if it deems it necessary to do so in order to protect itself against malicious activities of any kind. 

    3. The store can choose what products and services to offer and/or advertise for purchase and/or hire at any given time.

    4. The store is not legally required to sell products at the manufacturer suggested retail price. However, some manufacturers/suppliers may request that their products are sold at a given price. The store, however, reserves the right to offer prices lower than those requested by manufacturers/suppliers via the implementation of time-limited promotions, discount codes available to a selected group of users, and other ways similar in nature to the aforementioned.

      1. The store reserves the right, at its sole discretion, to select what discounts, promotions, and similar to offer, how to offer them, when to offer them, and to whom it offers them. 

  7. User Rights

    1. Users have the right to receive the products and/or services for which the store has collected payment from them.

      1. In cases in which the store finds it self unable to deliver or provide the products and/or services for which it has collected a payment, as provided in section 3., the user has the right to have their order amended by the store in accordance with section 4.4. 

    2. Users have the right to receive reasonably accurate descriptions of products and services available for purchase and/or hire. The shipping of products is a service provided by the store, the prices of shipping services can only be accurately advertised after a valid delivery address is known.

    3. Users have the right to receive transparent, accurate and truthful information from the store regarding any business transactions they engage in with the store. 

    4. Users have the right to have their personal information safeguarded when engaging in business with the store as outlined in the privacy section of this website, and in section 4.5. 

    5. Users have the right to to cancel any order for a full refund of the entire amount paid, if any, before products and/or services are shipped and/or provided.

    6. Users have the right to request refunds, rectifications and/or replacement products as specified on the shipping & returns section of this website. 

    7. Users have the right to be treated fairly, ethically and with respect in all situations when engaging in business with the store, and when dealing with the store in general. 

    8. Users have the right to not engage in business with the store.
